Who We Are
The Pinelands Good Food Club (referred to as “the Club”) is a private, membership-based buying club operated from a private home in Pinelands, Cape Town. We are a community of like-minded households who source good, wholesome, locally produced food together on a monthly basis. We are not a shop, retailer, or distributor. We do not operate for commercial gain.
Membership is by invitation or referral only and is a privilege, not a right.
1. Acceptance of Terms
By ticking the acceptance box when placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. This constitutes a binding agreement each time an order is placed. These Terms and Conditions are governed by the laws of the Republic of South Africa.
2. Membership
2.1 Membership is granted at the sole discretion of the Club’s facilitators and may be withdrawn at any time, with or without cause, and without obligation to provide reasons.
2.2 The Club reserves the right of admission and the right to refuse or revoke membership. In the event of revocation, any outstanding orders already paid for will be fulfilled or refunded at the facilitators’ discretion.
2.3 Membership is personal and non-transferable. Members may not place orders on behalf of non-members.
3. Ordering
3.1 Orders are placed monthly via the Club’s online ordering platform, which opens approximately two weeks before Market Day and remains open for approximately seven days.
3.2 Members are encouraged to plan ahead and order what they anticipate needing for the upcoming month.
3.3 Once the ordering window closes, orders are considered final. Cancellations or amendments after this point cannot be guaranteed and are at the facilitators’ discretion.
4. Payment
4.1 Invoices will be issued following Market Day, once orders have been collected and reconciled.
4.2 All invoices must be paid within two days of receipt.
4.3 It is the member’s responsibility to ensure their email address on record is current and that Club communications are not redirected to spam or junk folders.
4.4 Failure to pay within the stipulated period may result in suspension of ordering privileges or revocation of membership.
4.5 As invoices are issued after collection, members accept that payment is due for goods already received. Withholding payment does not constitute a valid dispute mechanism. Disputes regarding invoice accuracy must be raised separately in accordance with Clause 5.
5. Invoices and Disputes
5.1 Members must carefully check their invoice upon receipt and confirm that it accurately reflects what was ordered and what was received.
5.2 Any discrepancies or disputes must be raised in writing within 48 hours of receiving the invoice. Disputes raised after this period may not be considered.
5.3 In the event of a pricing error on the part of the Club, the correct price will apply. Members will be notified of any such correction and may cancel the affected portion of their order if they do not accept the revised price. The Club reserves the right to issue a corrected invoice at any time prior to or following payment.
6. Collection (Market Day)
6.1 Market Day takes place on the second Friday of each month (subject to change, with notice given to members). All orders must be collected on Market Day.
6.2 If a member is unable to collect on Market Day, we strongly advise that they do not place an order for that month. Due to the volume of goods handled, the Club is unable to store uncollected orders beyond Market Day.
6.3 Uncollected orders will be forfeited without refund unless prior arrangements have been made with the facilitators and agreed to in writing.
7. Shared Risk and Non-Delivery
7.1 The Club co-ordinates orders on behalf of its members but is not the seller of any goods. All produce is sourced directly from third-party producers and suppliers.
7.2 As a community, all members share in the risk associated with producer non-delivery, short delivery, or below-standard produce. Where this occurs, the Club will make every reasonable effort to obtain a credit or replacement from the relevant producer.
7.3 In the event of a shortfall or non-delivery, the Club will, where possible, issue a credit against a future order or a partial refund, at the facilitators’ discretion. No guarantee of a specific remedy is made.
7.4 The Club shall not be held liable for any loss, inconvenience, or expense arising from non-delivery or substandard goods from a third-party producer.
8. Food Safety and Assumption of Risk
8.1 All purchases made through the Club and all consumption or use of any goods are undertaken entirely at the member’s own risk.
8.2 The Club takes reasonable care to source from reputable producers and to handle goods appropriately prior to collection. However, the Club cannot guarantee the safety, quality, or suitability of any product for any individual’s dietary needs, health conditions, or allergies. It is the member’s responsibility to satisfy themselves in this regard before ordering.
8.3 Members who order temperature-sensitive goods, including but not limited to meat, fish, poultry, dairy, eggs, and raw milk products, accept full responsibility for maintaining the cold chain from the point of collection. Members must bring appropriate cool boxes and ice bricks to Market Day. The Club will not be held responsible for spoilage occurring after collection.
8.4 By accepting these Terms and Conditions, members agree to indemnify and hold harmless the Club, its facilitators, volunteers, agents, producers, and suppliers from any claim arising from food spoilage, allergic reaction, illness, injury, financial loss, or any other harm resulting from the purchase or consumption of goods obtained through the Club. This indemnity applies to the fullest extent permitted by law.
9. Limitation of Liability
9.1 To the maximum extent permitted by applicable South African law, the Club, its facilitators, and associated persons shall not be liable for any direct, indirect, consequential, or incidental loss or damage arising from membership of or participation in the Club.
9.2 Nothing in these Terms and Conditions seeks to exclude liability for gross negligence or wilful misconduct on the part of the Club’s facilitators.
10. Protection of Personal Information (POPIA)
10.1 The Club collects and processes members’ personal information, including names, contact details, physical addresses, and order history, solely for the purpose of administering membership and co-ordinating orders.
10.2 This information is stored securely and will not be shared with any third party, except where required by the producers and suppliers necessary to fulfil orders, or where required by law.
10.3 Members have the right to request access to their personal information held by the Club, to request corrections, or to request deletion of their data. Such requests may be directed to the Club’s facilitators in writing.
10.4 By accepting these Terms and Conditions, members consent to the collection and processing of their personal information as described above, in accordance with the Protection of Personal Information Act 4 of 2013.
11. Pricing
11.1 A small markup is added to all goods co-ordinated by the Club. This is kept as low as possible and exists solely to cover the time, resources, and administration required to run the Club.
11.2 Prices are subject to change without prior notice, in line with producer pricing and logistics costs.
11.3 Errors and omissions excepted (E&OE). The Club reserves the right to correct any pricing or invoicing errors at any time.
12. Dispute Resolution
12.1 In the event of a dispute between a member and the Club, both parties agree to first attempt to resolve the matter through good-faith discussion.
12.2 If the dispute cannot be resolved informally, both parties agree to refer the matter to a mutually agreed mediator in Cape Town before pursuing any formal legal proceedings.
12.3 These Terms and Conditions shall be interpreted and enforced in accordance with the laws of the Republic of South Africa, and the parties consent to the jurisdiction of the courts of the Western Cape.
13. Amendments
13.1 The Club reserves the right to amend these Terms and Conditions at any time. Members will be notified of material changes. Continued participation in the Club following notification of changes constitutes acceptance of the revised Terms and Conditions.
